Opinion by JUDGE STERNBERG In this action arising under the Uniform Child Custody Jurisdiction Act, § 14-13-101, et seq., C.R.S. 1973, the mother appeals an order in which the Denver district court held it did not have jurisdiction to enter an order concerning custody of the child, despite the fact that some years earlier the Denver court had entered a dissolution of marriage decree which included provisions about custody. We hold that the Denver district court did have jurisdiction, although it may decline to exercise that jurisdiction, and, therefore, remand the cause for further proceedings. The father filed a petition in Denver for dissolution of marriage in 1977. Thereafter, the parties entered into a separation agreement under one provision of which the father was given custody of the parties' minor child. Permanent orders incorporating that separation agreement were entered June 9, 1978.
